This Privacy Policy explains how EZTalking Vietnam ("we", "us", "our"), the legal entity operating the website eztalking.vn and the EZTalking AI learning platform (the "Service"), collects, uses, discloses, and safeguards personal data. It applies to all visitors, registered learners, trial users, and any individual who interacts with the Service from Vietnam, Taiwan, the United States, or any other location.

By accessing the Service or creating an account, you confirm that you have read and understood this Policy. If you do not agree with any part of it, please discontinue use of the Service.

• Service delivery — to create and maintain your account, deliver AI-driven pronunciation feedback, generate personalised lesson plans, and operate the AI tutor.
• Improvement & research — to analyse aggregated usage trends, train and refine our speech recognition and feedback models, and develop new features.
• Communications — to send you service-related notices (security alerts, policy updates, billing receipts) and, where you have opted in, product news and learning tips.
• Advertising — to display relevant ads through Google AdSense and to measure ad performance. See section 4 below.
• Safety & compliance — to detect fraud, enforce our Terms of Service, and comply with applicable law.

4. Google AdSense & Advertising

Google, as a third-party vendor, uses cookies to serve ads on our Service. Google's use of advertising cookies enables it and its partners to serve ads based on visits to this and other websites. You may opt out of personalised advertising by visiting Google Ads Settings. You may also opt out of certain third-party vendors' use of cookies for personalised advertising by visiting www.aboutads.info.

• Google AdSense — advertising (see section 4).
• Google Analytics 4 & Firebase Analytics — aggregated usage statistics.
• Google Cloud Platform & Firebase Hosting — secure data storage in Singapore / Iowa regions.
• OpenAI / Anthropic — AI tutor response generation under strict data processing agreements. Audio is sent only with your explicit consent.
• Stripe / payment processors — when you subscribe to a paid plan (not active during beta).

Each third party processes data under its own privacy terms. We require all vendors to provide adequate contractual safeguards.

7. Your Rights & Choices

Subject to applicable law, you have the right to:

1. Access the personal data we hold about you.
2. Correct inaccurate or incomplete data.
3. Delete your account and associated data ("right to be forgotten").
4. Restrict or object to certain processing activities.
5. Port your data in a machine-readable format.
6. Withdraw consent at any time, where processing is based on consent.
7. Lodge a complaint with a supervisory authority.

8. Legal Bases & Jurisdiction

Depending on where you reside, the following laws apply to our processing of your data:

• European Union / EEA — Regulation (EU) 2016/679 (GDPR). Our legal bases include consent, performance of contract, legitimate interests, and legal obligation.
• Vietnam — Decree 13/2023/NĐ-CP on Personal Data Protection (PDPD). We register cross-border transfers where required and honour your rights under Articles 9–13.
• Taiwan — Personal Data Protection Act (PDPA, 個人資料保護法). We collect data for specific purposes, with notice and consent as required.
• United States — California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA) for California residents.

9. Data Retention & Security

We retain personal data only as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Learning content and account data are deleted within 90 days of account closure, except where retention is required by law. Audio recordings used for model training are de-identified and aggregated before use.

We protect data with industry-standard measures: TLS 1.3 in transit, AES-256 at rest, role-based access controls, two-factor authentication for staff, and regular third-party penetration tests.

10. Children's Privacy

The Service is not directed at children under 13. We do not knowingly collect personal data from children under 13 (or under 16 in the EEA). If you believe a child has provided us with personal data, please contact privacy@eztalking.vn and we will delete the information promptly.

11. Updates to this Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify you by email or by a prominent notice within the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Policy.
